Mediation and Facilitation

Does it look as if your dispute with the cable operator or telephone company could be headed to litigation? Before taking another step down that path, consider whether an alternate form of dispute resolution might be appropriate.

Litigation consumes valuable resources otherwise available to each party. The financial resources that can be devoured an often the first that come to mind . . . but the cost in time and emotional expense can be significant as well. Litigation also poses another risk. Once a matter is before a court or jury, the outcome is influenced by a wide variety of uncertainties, and an all-or-nothing conclusion is typically reached. In some situations, these risks are appropriate to assume; for many matters already in litigation, however, an effort to mediate or facilitate a resolution to the dispute would have been an appropriate first step.
